New York Wrongful Death Attorneys Assist Grieving Families

Dedicated advocates hold negligent parties accountable for fatal injuries

There is no greater loss than the death of a cherished loved one due to some person’s negligent, reckless, or deliberate act. In some cases, it is possible for families to pursue justice through a criminal proceeding, but when criminal intent is missing, families must turn to the civil court system. If you have lost a loved one due to an auto accident, construction accident, medical malpractice, or other tortious event, The Tacopina Injury Firm is prepared to help. For more than 20 years, our attorneys have helped grieving families get the justice they seek in wrongful death litigation. We know that no amount of money can ever truly compensate for your loss, but a settlement or verdict can relieve financial pressures and, most importantly, hold the wrongdoers accountable.

Who can file a wrongful death lawsuit in New York?

New York law allows a personal representative of the decedent’s estate to file suit on behalf of the estate and for the benefit of individuals who have suffered losses due to the wrongful death. A personal representative must file suit within two years of the date of death.

What damages are available in a wrongful death lawsuit in New York?

New York law permits the decedent’s estate to recover for the following losses:

  • Funeral and burial expenses
  • Medical expenses related to the fatal injury
  • Lost income from the date of injury to the date of the decedent’s death
  • Conscious pain and suffering the decedent endured prior to death

Surviving family members may not recover damages for their own pain and suffering due to the loved one’s loss, but they may claim the following damages, if appropriate:

  • The value of financial support and personal services the decedent provided
  • The value of parental nurturing, care and guidance
  • Loss of inheritance

The law also provides for nine percent interest on the damage amount starting at the date of death up to settlement or verdict.
